On 11th May 2018, a High Court in Nigeria granted a guardianship order to the special guardians who had been appointed in care proceedings in England. The special guardians reside in Nigeria and Nigerian Guardianship Order was required to regularise the child’s placement in Nigeria.

Sami succeeded for the executor on behalf of the deceased estate in his claim in respect of funds left in a joint bank account the deceased had with his daughter. The Daughter relied on the presumption of advancement but her evidence was found not be credible in this regard and the funds left on the deceased’s death ordered to revert to the estate.

Mark Eldridge was successful in securing convictions of S18 against 2 defendants and perverting the course of justice for 2 others after a month long trial at Blackfriars Crown Court. The sentences ranged from 14 months to 14 years.

Kemi recently appeared in the Court of Appeal before Peter Jackson LJ and successfully resisted an application for permission to appeal against the decision of a Recorder by a Mother in respect of the interim removal of the subject children from her care. Kemi represented the Father who, together with the Children’s Guardian, had supported the local authority’s application for an Interim Care Order. There had been a long history of Private Law proceedings and the children were found to have suffered emotional harm.

Simon O’Toole’s practice includes all aspects of contentious and non-contentious property and trusts law. He is also regularly instructed in claims including but not limited to professional negligence. Since 2013, when Simon was elected to the Consultative Board of the HELP Programme in Strasbourg, he has increasingly provided advice on human rights issues.
Simon is a Master of the Bench of Inner Temple and currently Chair of the Inner Temple Outreach Subcommittee.
Simon also Chairs Wootton Academy Trust, and Charifaith Advisory Body (a CIF managed by BlackRock). His hobbies include sailing, skiing and opera.
Simon is qualified under the Direct Public Access to Barristers scheme.
