Dr Maia Love appears in the Court of Appeal
Dr Maia Love appears in the Court of Appeal this morning in the case of M (A Child). Dr Love will be led by Andrew Norton KC.
This is an appeal from a case management decision where the Judge determined an intermediary was not necessary for Maia's client, a vulnerable mother. The mother is facing an allegation of non-accidental injury to her 2 year old son.
A cognitive report detailed the mother’s cognitive profile and supported an intermediary assessment. An intermediary assessment opined the mother needed the assistance of an intermediary for every aspect of a hearing and also for conferences with her legal team.
The mother’s team argue that the Judge was wrong in law not to appoint an intermediary for the mother taking into account the evidence available and the Family Practice Rules. The Court have allowed the parties to address the wider aspects of when an intermediary should be appointed in the Family Court.
The appeal will be heard by Lady Justice King, Lord Justice Peter Jackson and Lord Justice Snowden in Court 69 and will be live streamed on the Court of Appeal YouTube channel.
