TOLATA and ownership disputes
Disputes over property ownership often arise in the course of relationship breakdown, whether that is a personal or business relationship. The law underpinning such cases is trusts-based, and they proceed under the Civil Procedure Rules but often in tandem with family proceedings. As a multidisciplinary set, we are in an ideal position to advise on cases where both specialist family and civil knowledge and experience is required.
We advise on a wide range of TOLATA cases, from those where a cohabiting relationship has come to an end and there is a dispute about ownership between the parties; to those where a third party is intervening into family proceedings (often a parent who has helped to fund the property purchase through The Bank of Mum and Dad); to contentious probate proceedings with a concurrent TOLATA dispute; to the dissolution of a business relationship and division of assets.
