Our commercial team specialise in representing businesses who are involved in litigation. Their expertise covers a wide range of business disputes, including breach of contract, debt collection and insolvency as well as property and employment disputes. 

Many of our barristers have worked in other businesses, so understand the commercial context of disputes. They are able to advise on the law but also the risk of reputational damage and the likely costs and time which any case will entail. This puts directors and business owners in the best possible position to decide on a strategy for dealing with litigation. 

We are strong advocates if the matter goes to court, but will also advise realistically on the prospects of settlement. We are experienced at representing clients at mediation, and on advising on sensible compromises including confidentiality clauses where they are appropriate. Many commercial clients instruct us repeatedly which means our barristers really get to know their business and are able to provide a high quality, personalised service.  

Our insolvency specialists deal with company and individual insolvencies and can advise sympathetically on anyone faced with this complex process. 

In relation to corporate insolvency, we advise companies who are facing administration orders, liquidation, receiverships and winding up petitions. Our members can advise on the insolvency process as well as the effect which insolvency will have on contracts and employees. We also take proceedings against companies who have ceased trading, and advise on asset recovery and setting aside transactions (such as those made at an undervalue or those transactions designed to defraud creditors).

In relation to individuals, we act for clients threatened with bankruptcy proceedings. We represent people seeking to set aside statutory demands and resist bankruptcy petitions. We advise directors facing disqualification proceedings. We also represent clients pursuing insolvency proceedings against individuals, including enforcement proceedings.  

Our barristers appear in the County Courts and High Court, and are knowledgeable about the insolvency rules and process.
