Children Law (Public)
Chuba specialises in family law, particularly in public law children matters. He regularly represents children, parents, intervenors, and Local Authorities in cases involving serious allegations such as physical and sexual abuse, as well as non-accidental injuries. He has considerable experience handling multi-day contested hearings, including fact-finding hearings. Chuba is also adept in cases involving Deprivation of Liberty, Secure Accommodation Orders, and Forced Marriage Protection Orders
Notable Cases
Re T (Fact Finding: Second Appeal) [2023] EWCA Civ 475
In this significant case, Chuba represented the father throughout the proceedings, from the initial issue to the second appeal in the Court of Appeal. The case involved a serious allegation by a 15-year-old girl against her stepmother, who was accused of facilitating sexual abuse over several years.
Children Law (Private)
Chuba is experienced in dealing with complex private children law matters, including cases involving serious physical and sexual abuse allegations, parental alienation, and disputes over Child Arrangements (residence and contact). He also handles cases involving occupation and non-molestation orders and represents children through a 16.4 Guardian.
Regulatory & Disciplinary
Chuba has established a strong regulatory practice, consistently earning instructions to appear before and advise professional regulatory bodies, including the HCPC (Health and Care Professions Council) and the NMC (Nursing and Midwifery Council). He adeptly represents registrants while also frequently acting as a case presenter on behalf of regulatory bodies.
Chuba is a trusted advocate in fitness to practise final hearings, substantive order reviews, appeal hearings, and interim order hearings. His experience spans multi-day proceedings addressing complex issues such as allegations of sexual misconduct, violence, dishonesty, and professional incompetence.
Notable Casework:
- HCPC v McEwen:
Chuba successfully represented a registered paramedic referred to the HCPC Competence and Conduct Panel following a conviction for assault by beating under section 39 of the Criminal Justice Act 1988. Despite the seriousness of the conviction, Chuba skilfully persuaded the panel that issuing a caution was sufficient. He effectively demonstrated that removing the paramedic from practice would not serve the public interest, particularly given the mitigating circumstances and the critical need for experienced healthcare professionals within the system.
· Sports Law
- Chuba has a strong interest in sports law, bolstered by his participation in Mishcon De Reya’s Sports Law Academy. He is particularly focused on regulatory and disciplinary proceedings initiated by sports governing bodies. A dedicated rugby player and enthusiastic football fan, Chuba also represented Nigeria in the 2022 KUGB World Karate Championship. His background in regulatory, disciplinary, and contractual disputes uniquely positions him to advise and act on sports law matters intersecting with these areas.
· Nigerian Law
- Qualified in both the UK and Nigeria, Chuba has developed expertise in commercial disputes, Oil & Gas matters, and arbitration. Before beginning his pupillage in the UK, he worked extensively in Nigeria, appearing before all levels of court, including the Federal High Court, Court of Appeal, and Supreme Court. Chuba continues to advise on and undertake contractual work related to Nigerian law.
